General Conditions

Article 1 – Use of the Vehicle

1. Authorized Drivers:

• The vehicle rented by the Hirer (Lessee), whose signature appears on this Rental Contract, may only be driven by the Hirer or persons authorized by ISLAND ROVERS (AL-JASHAAMI LTD, HE 457304).
• Unauthorized drivers or use of the vehicle in violation of this agreement voids insurance coverage.

• The vehicle must not be used for:
  • Paid carriage of passengers or participation in races.
  • Towing any vehicle or trailer.
  • Operation by anyone under the influence of alcohol or drugs.
  • Illegal activities or the transport of illegal goods.
  • Transport of a number of passengers exceeding the vehicle's registered capacity.
  • Driving outside areas under the full control of the Republic of Cyprus government or within the British Sovereign Base Areas. The vehicle must not be driven in regions occupied by Turkish forces or near those areas.

• The Hirer must lock and secure the vehicle when not in use and retain possession of the vehicle's documents. Under no circumstances should these be left inside the vehicle.
• The Hirer may not assign, sell, mortgage, or pledge this contract, the vehicle, its equipment, or tools.

Article 2 – Condition of the Vehicle and Additional Insurances

1. Vehicle Condition:

• The Hirer acknowledges receiving the vehicle in good operating condition, with all tires and equipment intact.
• The Hirer is responsible for any tire damage beyond normal wear and must replace any damaged tire with one of the same size and type.
• The Hirer is also liable for any damage to the windscreen or oil sump unless they have opted for additional damage waivers.

• The vehicle is insured according to the relevant insurance policy, with which the Hirer agrees to comply.
• The insurance does not cover the driver’s death or injury unless the Hirer has opted for Personal Insurance under the rental agreement.
• A copy of the insurance policy is available upon request at ISLAND ROVERS's main office.

Article 3 – Rental, Prepayment, and Extension

1. Rental Charges:

• The rental price and any prepayment requirements are detailed in the applicable rate list and must be paid in advance.
• Prepayment does not extend the rental period. Any extension must be pre-approved by ISLAND ROVERS and prepaid accordingly.
• The vehicle must be returned on the agreed date and at the designated location. Early returns do not qualify for refunds, but ISLAND ROVERS may credit the Hirer for future rentals.

Article 4 – Payments

1. Payment Responsibilities:

• The Hirer agrees to pay on demand:
  • Any additional charges for inter-city services, vehicle drop-off at unauthorized locations, or services outside of normal business hours.
  • All rental charges, special insurance premiums, and related fees.
  • Repair costs up to the deductible amount under the Collision Damage Waiver (CDW) or full market value of the vehicle if CDW is not purchased.
  • All taxes, fines, and assessments related to the rental.
  • Any sums due must be paid within 48 hours of the demand; otherwise, interest and additional penalties may apply.

Article 5 – Insurance

1. Third-Party Insurance:

• The vehicle’s third-party insurance complies with the terms and conditions of the relevant policy, which the Hirer acknowledges.
• The Hirer must take all necessary steps to protect the interests of ISLAND ROVERS and its insurance company in the event of an accident, including prompt reporting to the police and the rental company.

Article 6 – Maintenance and Repair

1. Vehicle Maintenance:

• ISLAND ROVERS covers normal mechanical wear. Any required repairs must be approved in writing and performed according to the company’s instructions. All repair bills must be itemized and submitted with the defective parts.

Article 7 – Fuel and Oil

1. Fuel Responsibility:

• The cost of petrol and diesel is the Hirer’s responsibility and is non-refundable. The Hirer must regularly check oil and water levels, submitting receipts for reimbursement where applicable.

Article 8 – Liability

1. Criminal Liability:

• The Hirer and authorized drivers are responsible for any traffic or parking violations committed during the rental period.

Article 9 – Contract Validity

1. Amendments:

• No amendments to this contract are valid unless agreed upon in writing by ISLAND ROVERS.

Article 10 – Financial Liabilities

1. Payment Authorization:

• The Hirer agrees that any financial liabilities arising from this contract can be deducted from their credit card without additional authorization.

Article 11 – Settlement of Disputes

1. Jurisdiction:

• Any disputes related to this contract will be resolved in accordance with the laws and courts applicable in the region where ISLAND ROVERS (AL-JASHAAMI LTD, HE 457304) has its registered office.
